BOONCART – TERMS OF USE
These Terms of Use (“Terms”) constitute a legally binding agreement between Booncart Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at [Address Placeholder] (“Booncart”, “Company”, “we”, “our”, or “us”), and any person (“User”, “you”, “your”) who accesses, browses, registers on, or transacts through the Booncart online marketplace www.booncart.com (“Platform”). These Terms govern your use of the Platform, including the purchase and sale of products, access to services, participation in Platform features, and all other interactions associated with your use of the Platform.
By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with Booncart’s Privacy Policy, Seller Terms, Return & Refund Policy, Shipping Policy, Cancellation Policy, and Grievance Redressal Policy, which together constitute the complete agreement between you and Booncart. If you do not agree to these Terms, you must not use the Platform.
Nature of the Platform and Role of Booncart
Booncart operates as a technology-driven online marketplace that facilitates transactions between independent third-party sellers (“Sellers”) and buyers (“Customers”). Except in cases where Booncart directly sells products under the Trade Model, all products listed on the Platform are sold by independent Sellers, and Booncart acts only as an intermediary facilitating the transaction.
Booncart does not own, endorse, control, or guarantee products sold by Sellers, nor does it provide any warranties other than those explicitly provided under law. In the Commission Model, Sellers bear full responsibility for product quality, authenticity, packing, dispatch, returns, and post-sale obligations.
You acknowledge that Booncart cannot be held liable for actions, omissions, negligence, default, or misconduct of Sellers or logistics service providers unless otherwise required under applicable law.
User Eligibility
Use of the Platform is permitted only to individuals who can form a legally binding contract under the Indian Contract Act, 1872. Individuals below the age of 18 may use the Platform only through a legal guardian or parent. By accessing the Platform, you represent that you meet the eligibility criteria.
Booncart reserves the right to deny access, restrict accounts, or terminate services to Users who violate these Terms, provide false information, misuse the Platform, or violate applicable laws.
Account Registration and User Obligation
To access certain features, you may be required to create an account by providing accurate personal details, such as your name, address, phone number, and email. You are solely responsible for maintaining the confidentiality of your login credentials and for any activities that occur under your account.
You agree not to:
- impersonate another individual or entity.
- use false, misleading, or incomplete information.
- attempt to access accounts, data, or systems without authorization.
- interfere with the Platform’s functionality or security.
- use the Platform for unlawful purposes or fraudulent transactions.
Booncart reserves the right to suspend or terminate accounts found in violation of these obligations.
Product Listings, Pricing, and Availability
Product listings on the Platform, including descriptions, images, prices, delivery timelines, and availability, are provided by Sellers or generated based on Seller inputs. While Booncart makes reasonable efforts to ensure accuracy, it does not guarantee the completeness, reliability, or error-free nature of listings.
Prices may fluctuate due to Seller discretion, market conditions, discount policies, or platform algorithms. Placing an order does not guarantee acceptance; Booncart reserves the right to cancel an order due to listing errors, stock unavailability, payment issues, suspicious activity, or technical failures.
Orders, Payments, and Refunds
Orders placed on the Platform are subject to acceptance and confirmation by Booncart or the Seller. Booncart facilitates multiple payment modes, including UPI, debit/credit cards, net banking, and cash-on-delivery (COD), subject to availability and User eligibility.
Completion of payment does not guarantee order acceptance. In case of cancellation or failure, refunds will be processed in accordance with Booncart’s Cancellation Policy and Return & Refund Policy. Refund timelines depend on banking and payment gateway processes and may vary for different payment instruments.
Shipping, Delivery, and Logistics
Shipping and delivery timelines displayed on the Platform are indicative. Actual delivery may vary based on location, Seller readiness, logistics capacity, courier constraints, and external circumstances beyond Booncart’s control. Booncart may use third-party logistics partners for order fulfilment.
Delivery failures arising from incorrect addresses, unavailability of the Customer, or inability to verify identity may result in Return-to-Origin (RTO), and corresponding charges may apply as per Booncart’s Shipping Policy.
Risk of loss or damage transfers to the Customer upon successful delivery at the designated address.
Returns, Refunds, and Replacements
Returns, refunds, and replacements are governed strictly by Booncart’s Return & Refund Policy. Customers must submit claims within the permitted timelines and provide necessary proof, such as photographs or unboxing videos.
Sellers bear full liability for defective, damaged, missing, or misrepresented products under the Commission Model. Booncart may intervene in disputes and determine eligibility for refunds or replacements based on evidence, courier records, and platform logs.
Booncart’s decision on returns and refunds shall be final and binding unless otherwise required by law.
User Conduct and Prohibited Activities
Users shall not engage in activities including, but not limited to:
- abusive behaviour toward Sellers, delivery personnel, or Booncart staff.
- fraudulent orders, payment manipulation, false claims, or misuse of return/refund mechanisms.
- posting defamatory, offensive, or illegal content on the Platform.
- interfering with listings, manipulating reviews, or engaging in harmful platform activities.
Booncart may restrict, suspend, or terminate User access for any violation and may initiate legal proceedings where necessary.
Reviews, Ratings, and User Content
The Platform may permit Users to post reviews, comments, photographs, or feedback. By posting content, you grant Booncart a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, or display such content in any manner.
- You agree that User-generated content must:
- be truthful and based on actual experience.
- not infringe intellectual property or privacy rights.
- not contain defamatory, abusive, or misleading information.
- not be posted for promotional manipulation or harassment.
Booncart may remove or moderate User content that violates these Terms or applicable laws.
Intellectual Property Rights
All text, designs, graphics, logos, icons, software, and Platform content are the exclusive property of Booncart or its licensors. Unauthorized use, reproduction, modification, or distribution of intellectual property is strictly prohibited.
Users may not copy, scrape, or extract Platform data for commercial use without written consent.
Data Protection and Privacy
All personal information collected from Users is processed in accordance with Booncart’s Privacy Policy, which outlines data practices, User rights, grievance mechanisms, and compliance with the DPDP Act.
Users consent to receiving communications from Booncart through SMS, email, WhatsApp, calls, or in-app notifications for operational and service-related purposes.
Third-Party Links and External Websites
The Platform may contain links to external websites or services. Booncart is not responsible for the privacy practices, content, or terms of such external platforms. Users are advised to review third-party policies before engaging with such services.
Suspension and Termination
Booncart may suspend or terminate User access, restrict platform privileges, or block orders if:
- the User violates these Terms.
- fraudulent or suspicious activities are detected.
- Booncart believes the User poses risk to the Platform, Sellers, or other Users.
- requests for KYC verification remain unfulfilled.
Termination may occur without prior notice where legally permissible.
Disclaimer of Warranties
The Platform and its services are provided on an “as is” and “as available” basis. Booncart makes no warranties regarding uninterrupted access, error-free operation, product suitability, Seller performance, or fulfilment accuracy, except where required under law.
Limitation of Liability:
To the fullest extent permitted by law, Booncart shall not be liable for:
- indirect, incidental, punitive, or consequential damages.
- loss of data, profits, or goodwill.
- delays or delivery failures caused by logistics partners.
- inaccuracies in product listings uploaded by Sellers.
- unauthorized access to User accounts.
- issues arising from misuse of the Platform by Sellers or Users.
Booncart’s liability, if any, shall be limited to the value of the concerned order.
Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Disputes shall first be addressed through Booncart’s Grievance Redressal Mechanism. Unresolved disputes shall fall under the exclusive jurisdiction of courts in Hyderabad, Telangana.
Changes to These Terms
Booncart reserves the right to modify, amend, or update these Terms at any time. Changes will be reflected on the Platform, and continued use of the Platform shall constitute acceptance of the revised Terms.
BOONCART – CUSTOMER TERMS & CONDITIONS
These Customer Terms & Conditions (“Terms”) govern your access to and use of Booncart Private Limited’s website, mobile application, and related digital services (collectively, the “Platform”). By accessing the Platform, creating an account, or transacting on the Platform, you agree to be bound by these Terms, our Privacy Policy, and any product-specific or service-specific terms as may be applicable. If you do not agree with these Terms, you must discontinue use of the Platform.
Booncart operates a dual-model marketplace consisting of (i) listings where products are sold directly by Booncart (“Trade Model”), and (ii) listings where the products are sold by independent third-party sellers while Booncart functions only as an intermediary (“Commission Model”). Your contract of sale may therefore be with Booncart or with a registered seller on the Platform, depending on the listing. All products, services, warranties, obligations, and performance standards shall be governed accordingly.
Use of the Platform is permitted only to individuals who are competent to enter into legally binding contracts under the Indian Contract Act, 1872. You represent that all information submitted to the Platform is true, accurate, and complete, and that you shall maintain the confidentiality of your account credentials. Any activity undertaken under your account shall be deemed to be authorised by you.
Orders, Acceptance and Cancellation
When you place an order on the Platform, it constitutes an offer to purchase the product displayed therein. Booncart or the concerned seller reserves the right to accept or reject the order at its sole discretion. An order may be rejected due to non-availability of stock, inaccuracies in product information, pricing errors, high-risk behaviour, excessive prior returns, or inability to verify the shipping address or contact details. Booncart also reserves the right to cancel orders that are flagged under its fraud-monitoring and safety systems. Customers engaging in misuse including filing false damage claims, submitting manipulated or incomplete unboxing videos, attempting fake RTOs, or repeatedly refusing Cash-on0Delivery (COD) orders without valid reason may have their accounts restricted, COD privileges removed, or permanently blocked from the Platform.
Orders once placed may be cancelled by the customer only until the item is dispatched. After dispatch, cancellation may not be feasible. In case of preorders and customised items, cancellations are generally not permitted as such items are manufactured or procured specifically on request. Such orders are non-refundable unless the product received is defective or the order is not fulfilled beyond a reasonable delay.
Pricing, Payment and Taxes
All prices displayed on the Platform are inclusive or exclusive of taxes as indicated. Prices may fluctuate due to demand, seller policies, or other factors. Booncart reserves the right to modify pricing without prior notice. Payments may be made through various instruments such as credit/debit cards, UPI, net banking, wallets, or cash-on-delivery (“COD”), subject to availability. COD may be restricted or disabled for customers with a history of repeated order refusal, RTO patterns, high-risk behaviour, or incomplete address verification. Booncart may further request identity confirmation or alternative verification prior to accepting COD orders. Booncart shall not liable for delivery failures or delays arising from customer-related issues, including but not limited to incorrect or incomplete addresses, unavailability at the time of delivery, refusal to accept orders, or misuse or mishandling of products after delivery.
Shipping, Delivery and High-Value Protocols
Delivery timelines displayed on product pages or checkout screens are indicative and subject to change due to courier constraints, weather conditions, disruptions, operational delays, or other factors beyond Booncart’s control. The responsibility of timely delivery in the Commission Model lies primarily with the seller and its assigned logistics partner, while in the Trade Model Booncart undertakes such responsibility directly.
For certain high-value items, the delivery agent may request identity verification, OTP confirmation, or alternate authentication to ensure safe delivery. If the customer is unreachable during delivery attempts, or if the address is incomplete or incorrect, the shipment may be marked as undelivered and returned to origin (“RTO”). For prepaid orders where an RTO occurs due to customer unavailability or refusal, Booncart may deduct two-way shipping, handling, and payment gateway charges before issuing refunds.
Returns, Replacements and Refunds
Return and replacement eligibility varies based on product category, seller policy, hygiene considerations, and statutory requirements. Certain items such as personal-care goods, cosmetics, perishable goods, made-to-order products, and items explicitly marked “non-returnable” are not eligible for returns unless defective or damaged.
To maintain platform integrity and safeguard sellers against fraudulent claims, Booncart requires customers to provide a clear and continuous unboxing video at the time of opening the sealed package for any claims relating to missing items, tampered packaging, wrong products, or damage. Claims without appropriate visual evidence may not be accepted. Customers must report any return-related issue within 48 hours of delivery; after expiry of this window, claims may be rejected.
Upon approval of a return request, the item must be returned in its original condition, including packaging, labels, manuals, freebies, and accessories. Refunds shall be processed only after successful pickup and quality assessment. Refund timelines depend on the payment instrument and banking/UPI channels involved.
In the case of products covered under manufacturer warranty, customers shall be required to approach authorised service centres directly. Booncart does not assume responsibility for warranty obligations for products sold under the Commission Model, except where expressly stated or where mandated under law.
Customer Responsibilities
Customers agree not to misuse the Platform, including but not limited to: placing fake orders, repeatedly refusing COD deliveries, submitting fraudulent return claims, abusing return/refund privileges, or harassing delivery personnel, sellers, or support staff. Booncart reserves the right to suspend or terminate accounts that engage in such activities, restrict delivery methods, or limit COD/payment options to maintain platform safety.
Customers must ensure that delivery information is accurate and that they are available to accept delivery as scheduled. Failure to do so may lead to delays, RTO events, and deductions in prepaid refund amounts.
Marketplace Nature and Limitation of Liability
Booncart acts as an intermediary for transactions under the Commission Model and shall not be responsible for the manufacturing, quality, suitability, fitness, or warranty of products listed by third-party sellers. All obligations relating to such products shall be borne by the concerned seller. Booncart may assist in dispute resolution as a facilitator but does not assume the responsibilities of a seller unless specifically stated under the Trade Model.
To the fullest extent permitted under law, Booncart shall not be liable for indirect, incidental, special, or consequential damages arising out of the use of the Platform, delays in delivery, product defects attributable to third-party sellers, or actions of logistics partners. Booncart’s liability, if any, shall be limited to the value of the transaction under dispute.
Communications and Notifications
By using the Platform, you consent to receive transactional communications related to your orders, shipping updates, account activity, and service notifications via SMS, phone calls, email, WhatsApp, or push notifications. Promotional messages shall be sent only in accordance with your communication preferences, which may be modified within your account settings.
Modifications to the Terms
Booncart reserves the right to update, modify, or replace these Terms at any time. Any changes shall be posted on the Platform, and continued use of the Platform shall constitute acceptance of such modifications.
Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms or from the use of the Platform shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana. Booncart may also facilitate mediation or internal dispute-resolution mechanisms where appropriate.
BOONCART – FRAUD PREVENTION & ABUSE POLICY
This Fraud Prevention & Abuse Policy (“Policy”) outlines the measures, responsibilities, controls, and enforcement actions adopted by Booncart Private Limited (“Booncart”, “Company”, “we”, “our”, or “us”) to safeguard the trust, integrity, and safety of the Booncart marketplace (“Platform”). This Policy applies to all users of the Platform, including customers, sellers, delivery partners, and any third party who interacts with the Platform (“User”, “you”, “your”). It must be read together with the Terms of Use, Privacy Policy, Seller Terms, Seller Penalty Policy, and all other operational policies of Booncart.
Booncart is committed to ensuring that the Platform remains free from unlawful activities, fraudulent practices, misuse of facilities, abuse of policies, and conduct that undermines customer protection and marketplace integrity. Any behaviour that is inconsistent with the legitimate use of the Platform may result in investigation, restriction, penalties, or permanent removal from Booncart.
Purpose and Scope
This Policy aims to preserve the safety, authenticity, and reliability of the Booncart ecosystem. Fraud prevention is essential to protect customers from deceptive practices, ensure sellers operate lawfully, safeguard payment systems, prevent financial losses, and maintain compliance with applicable laws. Fraud or abuse may be perpetrated by customers, sellers, or third parties, and may range from return manipulation to counterfeit products, fake accounts, payment misuse, or attempts to circumvent Platform processes.
The scope of this Policy extends to all products, orders, listings, transactions, interactions, and activities carried out through the Platform. It governs both preventive controls and enforcement actions that Booncart may undertake whenever fraudulent or abusive behaviour is identified. Fraud may arise in several forms, including customer fraud, seller fraud, logistics fraud, account – takeover attempts, return and refund abuse, and misuse of promotional coupons or gift cards, all of which fall within the scope of this policy.
Fraud and Abuse by Customers
Booncart maintains systems to detect and prevent fraudulent activity originating from customer accounts. Such activity may include misuse of promotional offers, creation of multiple accounts to obtain undue benefits, return abuse, manipulation of refund procedures, repeated refusal of Cash-on-Delivery (“COD”) orders, placing false complaints, providing incorrect or unverifiable address information, and engaging in behaviour intended to deceive sellers or the Platform.
Return abuse includes scenarios where customers repeatedly return products without valid reasons, tamper with items, or attempt to replace delivered items with different or damaged products. Booncart may analyse behaviour patterns, investigate suspicious return trends, and restrict return privileges, withdraw COD eligibility, suspend accounts, or take other corrective actions deemed necessary. Booncart follows a graded penalty and escalation framework for customer-related fraud. First-time or low-severity violations may result in warnings or temporary restrictions, while repeated, high-risk, or intentional fraudulent behaviour may lead to withdrawal of return privileges, permanent removal of COD eligibility, suspension of account functions, payout or refund holds, and final account deactivation without further notice. The severity of action depends on the nature and frequency of the violation and the risk posed to the Platform.
Where customer behaviour indicates intentional fraud, including involvement in financial chargebacks, unauthorised payment use, or identity misuse, Booncart may fully restrict account access, freeze refunds pending investigation, deny future orders, or initiate legal action.
Fraud, Manipulation, and Misconduct by Sellers
Sellers are strictly required to maintain authenticity, operational integrity, and full compliance with Booncart’s policies. Fraudulent conduct by Sellers may include listing counterfeit or unsafe products, manipulating inventory, providing fake or reused tracking information, cancelling orders to manipulate stock, inflating reviews or ratings, using false identities, contacting customers outside authorised channels, or attempting to circumvent Booncart’s verification systems.
Additional violations include delivering incorrect, empty, or tampered packages, misrepresenting product attributes, altering MRP labels, using unauthorised branding, and artificially boosting product visibility. Booncart may take strict action against such behaviour, including delisting listings, freezing payouts, suspending fulfilment privileges, or permanently disabling the Seller account.
If Seller conduct poses a safety threat or involves counterfeit or illegal products, Booncart may cooperate with brands, authorities, and enforcement agencies to pursue civil or criminal proceedings. Booncart also treats the submission of false or manipulated unboxing videos, intentional return fraud, or acceptance of wrong-item returns as serious violations. Any Seller found engaging in practices such as providing staged evidence, disputing returns dishonestly, or attempting to conceal product discrepancies through falsified media may face immediate payout holds, withdrawal of selling privileges, and permanent account deactivation.
RTO Misuse and Delivery-Related Fraud
Return-to-Origin (“RTO”) misuse occurs when customers intentionally refuse delivery without valid reason or manipulate the COD process, or when Sellers delay dispatch, manipulate pickup attempts, or misuse logistics processes. Booncart continuously evaluates RTO patterns, delivery failures, and discrepancies in shipping behaviour. Identified misuse may result in restrictions on COD, imposition of penalties, reassignment of logistics charges, or account suspension. Where RTO misuse or logistics-related fraud involves deliberate deception, financial loss, counterfeit activity, identity misuse, or interference with delivery systems, Booncart may initiate formal criminal complaints with law-enforcement or cybercrime authorities. Such cases may be escalated under applicable provisions of the IPC, IT Act, and other relevant laws whenever the conduct indicates criminal intent.
In circumstances where Sellers engage in logistics-related fraud such as marking orders as shipped without actual handover, providing fake AWB numbers, or interfering with courier systems. Booncart will enforce strict penalties and may refer the matter to law enforcement.
Misuse of Payments, Returns, and Refund Mechanisms
Booncart employs banking-level security systems, AI tools, and automated checks to monitor payment patterns and refund transactions. Fraud involving payment misuse may include use of stolen payment credentials, chargeback manipulation, unauthorised access, or interception of refund methods. Refund abuse, including repeated false claims of non-delivery, damage, or incorrect product complaints, may lead to investigations and reversal of refund eligibility.
Booncart reserves the right to suspend refunds, place holds on funds, or request additional verification when fraudulent behaviour is suspected. Payments may remain frozen until investigations are complete and risks fully mitigated. Users found repeatedly abusing payment systems, refund mechanisms, or return processes may be placed on a cooldown period during which ordering, refunds, or return privileges may be temporarily restricted. In cases of high-risk or repeated fraudulent behaviour, Booncart may permanently blacklist the account and block associated phone numbers, devices, payment instruments, or addresses to prevent further misuse.
Marketplace Abuse, Account Misuse, and Policy Circumvention
Attempts to bypass Platform rules such as creating multiple Seller accounts without authorisation, using proxy identities, manipulating category placements, or masking non-compliant listings constitute serious violations. Similarly, customers who create multiple identities to exploit promotions, cashback offers, or free delivery thresholds may face immediate restrictions.
Booncart may also prevent users from rejoining the Platform after suspension by blocking associated phone numbers, addresses, payment instruments, network identifiers, or devices. Any deliberate attempt to re-register after banning is considered fraudulent conduct. Creating or operating multiple customer or seller accounts by the same individual for the purpose of evading restrictions, duplicating benefits, or manipulating Platform processes is strictly prohibited and may result in immediate suspension or permanent disabling of all linked accounts.
Automated Detection, Behaviour Monitoring, and Risk Scoring
Booncart uses machine-learning models, behavioural analytics, transaction scoring, device fingerprinting, and fraud-monitoring algorithms to identify abnormal activity. These systems evaluate patterns such as unusual order spikes, abnormal cancellation rates, high return ratios, multiple failed deliveries, inconsistent login activity, or atypical Seller behaviour.
Booncart may combine automated analysis with manual review, evidence gathering, product audits, packaging checks, or customer verification. Users may be required to provide additional identity proofs, address confirmations, bank details, or order validation information during such checks. Where automated or manual reviews identify activity that may involve criminal conduct, Booncart may cooperate with law-enforcement, cybercrime authorities, and regulatory bodies by providing relevant transaction data, device identifiers, communication logs, and verification records in accordance with applicable law, to assist in the investigation of fraud or unlawful activities.
Investigations, Enforcement Actions, and Payout Holds
Whenever suspicious activity is detected, Booncart may initiate an internal investigation, during which certain user privileges including access to listings, ability to place orders, or eligibility for payouts may be temporarily suspended. In the case of Sellers, settlement amounts may be withheld until the investigation concludes, particularly when funds relate to orders under dispute or refunds to customers.
Depending on the severity of the misconduct, enforcement actions may include account suspension, delisting of products, restriction of marketplace features, reversal of benefits, recovery of financial losses, or permanent removal of the User from Booncart. Booncart may also report unlawful activity to banks, payment processors, brand partners, or relevant government authorities.
Cooperation with Law Enforcement and Regulatory Authorities
Booncart complies with requests from legal, regulatory, and enforcement bodies investigating fraud, counterfeit operations, tax compliance issues, or unlawful activities. We may share relevant information, including transaction records, communication logs, KYC documents, or device identifiers, in accordance with applicable law. Booncart reserves the right to take legal action against individuals or entities engaging in fraud or abuse of the Platform.
Data Protection and Confidential Handling of Evidence
All investigations and fraud-prevention processes involving personal data are conducted in accordance with the Digital Personal Data Protection Act, 2023 and Booncart’s Privacy Policy. Data collected during risk analysis or fraud detection is handled securely, stored responsibly, and used exclusively for prevention of fraud, enforcement of Platform rules, internal audits, or compliance with legal obligations.
Amendments to the Policy
Booncart reserves the right to amend, modify, or update this Policy at any time to account for evolving risk patterns, technological advancements, regulatory updates, and operational adjustments. Changes will be published on the Platform, and continued use of the Platform after such updates constitutes acceptance of the revised Policy.
BOONCART – PROHIBITED & RESTRICTED PRODUCTS POLICY
This Prohibited & Restricted Products Policy (“Policy”) governs the categories of products that Sellers (“Seller”, “you”, “your”) are permitted or prohibited from listing, advertising, or selling on the Booncart Marketplace (“Booncart”, “we”, “our”, “us”). This Policy forms part of the Seller Terms & Conditions, the Seller Code of Conduct, the Seller Penalty & Enforcement Policy, and all other applicable Platform rules. By listing products on the Booncart Platform (“Platform”), the Seller acknowledges and agrees to comply with this Policy in full.
Booncart is committed to maintaining a safe, lawful, and trustworthy marketplace. To protect customers, comply with regulatory requirements, and preserve the integrity of the Platform, Sellers must ensure that all products they list meet applicable legal, safety, quality, and authenticity standards. Booncart reserves the right to remove any listing, restrict Seller access, or take enforcement action where a product violates or is suspected to violate this Policy.
Overview and Purpose
The purpose of this Policy is to define which products are strictly prohibited from being listed or sold on Booncart, and which products may be listed only under specific conditions, regulatory approvals, or compliance requirements. Booncart operates as a marketplace and depends on Sellers to provide accurate information, lawful products, and high standards of safety and authenticity. Any item that jeopardises consumer safety, infringes intellectual property, breaches licensing requirements, violates statutory restrictions, or undermines the reliability of the Platform is not permitted.
This Policy also ensures Booncart’s compliance with Indian laws including the Consumer Protection (E-Commerce) Rules 2020, the Legal Metrology Act, 2009, the Drugs and Cosmetics Act, 1940, the Food Safety and Standards Act, 2006, the Information Technology Act, 2000, intellectual property laws, BIS guidelines, and all other regulations governing the sale of goods online.
Prohibited Products
Certain categories of products are categorically prohibited from being listed on the Platform under any circumstances. These include items that are illegal, unsafe, restricted by law, harmful, fraudulent, or inappropriate for sale to consumers. Products that promote unlawful activity, infringe IP rights, mislead customers, or lack statutory permissions are also strictly barred.
Booncart expressly prohibits listings that involve counterfeit goods, unauthorised branded products, pirated content, recalled items, illegal substances, offensive materials, stolen goods, or any product that violates regulatory compliance. Items that pose a health hazard, environmental risk, or safety threat are similarly forbidden. No Seller may attempt to disguise, mislabel, or modify product data to bypass these restrictions.
If a prohibited product is listed, whether intentionally or unintentionally, Booncart may immediately remove the listing, restrict the Seller account, freeze payouts, or permanently disable the Seller without prior notice.
Restricted Products
Restricted products may be allowed on Booncart, but only if the Seller obtains and submits the necessary statutory licences, regulatory approvals, safety certifications, compliance documentation, and brand authorisations required under Indian law. These may include items such as certain electronics, food items, cosmetics, supplements, batteries, medical devices, baby products, and other regulated goods that require specific certifications.
Sellers must ensure that every restricted product complies with applicable regulations including BIS certification for electronics, FSSAI licensing for food items, CDSCO permissions where required, Legal Metrology declarations, and safety standards applicable to children’s goods. Expiry-sensitive products must display accurate manufacturing, batch, and expiry information. Failure to provide these details may render the product ineligible for sale.
Where Booncart suspects non-compliance or receives a complaint regarding a restricted product, it may request supporting documentation such as test reports, invoices, brand letters, regulatory certificates, or approval numbers. The burden of demonstrating compliance rests solely with the Seller.
Counterfeit, Infringing, and Unauthorised Goods
Booncart maintains a zero-tolerance policy for counterfeit goods, unauthorised replicas, imitation products, fake branded merchandise, infringements of trademarks, copyright violations, or exploitation of intellectual property belonging to any third party. Sellers must possess legitimate sourcing documents and brand authorisations for branded items.
Misuse of brand names, unauthorised use of logos or trademarks, selling “first copies”, or altering packaging to misrepresent product origins constitutes a severe breach. Any Seller found listing counterfeit or infringing goods may face delisting of the listing, suspension of all associated accounts, permanent removal from the Platform, withholding of settlements, and legal referral to enforcement agencies or brand owners.
Product Safety, Quality, and Compliance Requirements
Every product listed on Booncart must meet safety, quality, and manufacturing standards as required under Indian law. Sellers may not list products that are expired, damaged, refurbished (without proper labelling), untested, contaminated, poorly manufactured, or otherwise unsafe for consumer use.
Products intended for ingestion, topical application, child use, or electrical operation must conform to category-specific safety standards. Examples include BIS certification for certain electronic and electrical appliances, FSSAI requirements for food, approved formulations for cosmetics, and adequate labelling for items intended for children. Non-compliance may lead to immediate product delisting and further action under the Seller Penalty & Enforcement Policy.
Misrepresentation, Mislabelling, and Deceptive Listings
Sellers must describe products honestly and accurately. Any form of misrepresentation including inaccurate descriptions, misleading images, manipulated specifications, deceptive claims, incorrect category placement, falsified MRP labels, or omission of mandatory declarations constitutes a violation of this Policy.
Listings that intentionally obscure defects, misstate product origins, conceal seller identity, inflate reviews, or create a misleading impression of product quality undermine customer trust and are strictly prohibited. Booncart may remove such listings, issue warnings, impose penalties, or suspend the Seller account depending on severity.
Enforcement, Monitoring, and Marketplace Safeguards
Booncart employs automated systems, behavioural analysis tools, manual audits, and customer feedback mechanisms to detect prohibited or non-compliant products. Product categories may be monitored for authenticity risks, safety concerns, or regulatory violations. When Booncart identifies or suspects a violation, it may conduct an investigation, seek additional documentation, or perform product sampling and testing.
Depending on the findings, Booncart may remove listings, impose penalties, restrict product uploads, freeze payouts, or permanently disable the Seller account. Booncart may also notify regulatory authorities or brand owners of violations involving counterfeit, unsafe, or illegal products.
Seller Responsibility and Legal Compliance
Sellers bear full responsibility for ensuring that all listed products comply with the laws of India and with the Platform’s standards. Booncart does not assume liability for unlawful or non-compliant listings uploaded by Sellers. The Seller warrants that each product is legitimate, safe, compliant, and lawfully sourced, and acknowledges that failure to comply may result in legal proceedings initiated by authorities, brands, or impacted consumers.
Sellers are encouraged to stay updated with applicable laws, especially in categories involving health, safety, food, children’s products, electronics, medical devices, and regulated goods. Ignorance of compliance standards does not absolve the Seller of responsibility.
Amendments to the Policy
Booncart reserves the right to update or modify this Policy at any time in response to changes in law, regulatory requirements, enforcement practices, or operational conditions. Any updates will be published on the Platform, and continued use after such updates constitutes acceptance of the revised Policy.
